Cabinet approves introduction of the Surrogacy (Regulation) Bill, 2016

The Union Cabinet has on 24th August 2016 given its approval for introduction of the “Surrogacy (Regulation) Bill, 2016” (”Bill”). The Bill will regulate surrogacy in India by establishing National Surrogacy Board at the central level and State Surrogacy Boards and appropriate authorities in the State and Union Territories. The Bill shall apply to whole of India, except the state of Jammu and Kashmir.  (more…)

Unwed mothers do not require to name father to attain a child’s lawful custody

The Supreme Court of India on 6th July 2015 in a landmark judgment in the matter of ABC v. The State [(NCT of Delhi) AIR 2015 SC 2569] held that a single/ unwed mother is not required to name the biological father of the child whom she has given birth to. The verdict came from the appeal made by an unwed Christian mother who wanted to make her child a nominee for all purposes, including her investments. (more…)

Government eases passport issuance for adopted children

The Ministry of External Affairs vide notification dated 26th May 2015 exempted orphan/abandoned children born on or after 26th November 1989 from the mandatory requirement of submission of Birth Certificate issued by the Municipal Authority or the Registrar of Births & Deaths as proof of Date of Birth (“DoB”) whilst applying for passport under the provision of the Passports Rules, 1980.
